South Australia's Planning System is changing. The Planning and Design Code will replace the Adelaide (City) Development Plan on 19 March 2021. Find out more at plan.sa.gov.au.

South Australia’s urban and regional planning system has undergone its biggest reform in over 25 years and was implemented on 19 March 2021.

The State Planning Commission led the change, resulting in the planning system underpinned by the new Planning, Development and Infrastructure Act 2016 (SA) (PDI Act) which introduces a raft of new planning tools.

The new planning and development system affects how development policy is formed and amended, and how development applications are lodged and assessed.

A significant element of the planning reform involved replacing all 72 South Australian Development Plans with a single state-wide planning rule book, the 'Planning and Design Code'.

From 19 March 2021, all Development Applications will be assessed under the Planning and Design Code.

Importantly, lodging, tracking, paying and assessment of all Development Applications has been centralised to a state system.

The new planning and development system will affect how development policy is formed and amended, and how development applications are lodged and assessed in the future.


Planning and Design Code

One of the biggest elements of the planning reform involves replacing all 68 Council Development Plans with one single state-wide planning rule book – the Planning and Design Code (the 'Code').

South Australians have an opportunity to provide feedback on the revised draft Planning and Design Code (Code) from 4 November 2020 to 18 December 2020. An overview of the key changes and proposed improvements to the revised draft Code are highlighted in the Summary of Post-Consultation Amendments (PDF, 1158 KB) to support the consultation feedback process.

This opportunity follows an initial five-month period of public consultation on the draft Code (October 2019 to February 2020), which resulted in over 2000 submissions. In response, significant updates have been made to the Code, including the addition of new overlays and zones to better reflect local conditions and address areas of community interest. The City of Adelaide provided a response to the State Planning Commission on Phase 3 of the Draft Planning and Design Code on 28 February 2020. The introduction of the Code will result in changes that will impact every property in some wayThese will include:

  • Changes to public notification of development applications;

  • Removal of your current right to appeal against most development applications on a neighbouring site;

  • Possible changes to your zoning;

  • Likely changes to the policies which apply to your property.

    Update: 7 February 2020

    Planning Reform Implementation Delayed

    Today, Planning Minister Stephan Knoll has announced that the implementation of this once in a generation reform will be delayed. This announcement has been made via InDaily today and confirmed by the State Planning Commission with a letter to Councils CEO.

    The Planning Minister states that this decision has been based on the advice of the State Planning Commission, from feedback from local government, community and stakeholders (including the Urban Development Institute of Australia).

    The change will involve removing the mandated 1 July 2020 date from the PDI Act, and replacing with a provision in the associated Regulations which will enable a new date to be set by proclamation in the South Australian Government Gazette. However, the Minister has indicated that this date will likely by September 2020.

    This is an excellent result, as it will allow the state government additional time to refine and test the Planning and Design Code, and give the community, Council and practitioners more time to understand the changes. It will also allow the state government more time to complete the centralised ePlanning solution including possible necessary enhancements. And importantly, it will allow the state government to initiate an effective training program for the new planning system and ePlanning solution and give Council time to prepare and become business-ready before the new planning system is switched on.

    Please note, this announcement has not amended the consultation deadline for the Draft Planning and Design Code, with submissions on the Draft Code due 28 February 2020.

    The State Planning Commission is holding a series of community information sessions as part of the consultation on the draft Planning and Design Code. These will take place at locations throughout the metropolitan and greater Adelaide area during November and December 2019. How the draft Code relates to the Adelaide Council area will be covered at the session scheduled for December 12.
