Why are the Outdoor Dining Operating Guidelines being changed?

All of Adelaide City Council’s Operating Guidelines are reviewed periodically to ensure they are still relevant and useful. The Outdoor Dining Operating Guidelines were last reviewed in 2009 and since then Council has increased its focus on activation and placemaking.
Changes have been made to the Guidelines to align them with this focus whilst maintaining safety and accessibility.  They have been rewritten to make them clearer and simpler for businesses to use.

What changes have been made to the Guidelines?

In addition to making the wording clearer and simpler, several changes have been made to the outdoor dining requirements that businesses applying for a new Outdoor Dining Permit need to be aware of.  These changes aim to make it easier for more businesses to have outdoor dining as well as make it easier for businesses currently operating outdoor dining areas to align with the requirements.

I already have an Outdoor Dining Permit, do I have to comply with the new Guidelines?

Enforcement of the revised Guidelines is not retrospective and as such businesses with existing Outdoor Dining Permits will not be required to align with the new Guidelines. It is anticipated however that most of the changes to the Guidelines will make it easier for businesses to manage their outdoor dining area. If an application is made to transfer an Outdoor Dining Permit or significantly alter an existing outdoor dining area, the requirements of the reviewed Guidelines will become relevant.

Were businesses consulted when making changes and drafting the reviewed Guidelines?

Council staff had a great deal of accumulated knowledge regarding the challenges businesses face in establishing and maintaining outdoor dining under the current Guidelines. This knowledge was fed into the review process along with the results of a survey of sixty outdoor dining businesses conducted in October 2012.
Council also gained practical knowledge about the impact of particular outdoor dining regulations through the Splash Adelaide (Outdoor Dining) trial in 2012/13.

How do I provide my feedback?

This consultation is aimed at business owners and State Government departments/ peak bodies/ special interest groups.

Business owners are encouraged to provide feedback using the feedback form available online at www.yoursay.adelaidecitycouncil.com/outdoor-dining-guidelines or in hardcopy from the Customer Service Centre or Enterprise Adelaide.
Complete the Feedback Form which asks specific questions about the reviewed Operating Guidelines and provides an opportunity for general comments regarding the Guidelines.
All written feedback forms must be received by 5.00 pm on Friday 23rd May 2014. Forms completed online can be submitted via the website.

Submission Form

Submissions must include the name and business address of the respondent, and will be included in a report to Council which will be publically available.

All written submissions must be received by 5.00 pm on Thursday 12 June 2014. Forms completed online can be submitted via the website.

What happens to my feedback?

Feedback provided through this consultation will be used to inform Council on any further changes that need to be made to the reviewed Guidelines.

Following this consultation the reviewed Guidelines will be presented to Council Committee. Once the reviewed Outdoor Dining Operating Guidelines have been approved by Council they will become the Guidelines against which future Outdoor Dining Permit applications are assessed.
