Project update

Thank you for your feedback. Following consultation the (reviewed) By Laws were updated and adopted by Council on 14 August 2018. They were then Gazetted and tabled with the Legislative Review Committee. The new By-Laws came into effect on 23 December 2018.

The new By-Laws will expire on 1 January 2025. The next review process will commence at least 7 months prior to 1 January 2025.

Project information

To comply with State Government legislation requirements CoA has recently reviewed and (in some instances) revised its current By-laws. As required by State legislation CoA is now seeking feedback from the public on its revised By-laws.

Background

Council has a general power to make By-laws which are designed to provide good rule and governance and assist council in providing a convenient, safe and comfortable space for its community.

Council’s power to make a By-law is derived from Section 246 of the Local Government Act 1999 (SA) which requires the review and formal adoption of the By-laws. Council currently has 10 By-Laws (refer Consultation Pack).

It is a legislated requirement that Council reviews (and if necessary revises) its By-laws every seven years.

The By-laws have, therefore, been reviewed and some changes proposed. The vast majority of the proposed changes are minor in nature and a result of legislative, interpretive or grammatical factors. The outcome is nine new By-laws (refer Consultation Pack). In accordance with current SA legislation Council is providing the public with an opportunity to comment on the proposed nine new By-laws.
